I need your guidence with landlord / developer
I wish your guidance with respect to following problem faced by me:
1 Our land lord made an agreement for redevelopment our dilapidated Chawl few years back.
2. Because of 70% consent rule we had to sign an agreement with Landlord even though some terms of agreement were not to our liking because more than 70% people signed the agreement.
3. Now the landlord/developer have failed to fulfill contractual obligation such as timely completion, quality of work, inspection clause, amenities, formation of society, conveyance of the land,etc.
4. Under the agreement we are suppose to appoint arbitrator in case of any dispute through a body called “Tarun Mandal” This body was formed with good faith in the members of the body. However chairman and secretary of the body started siding with Landlord and other members have been maintaining silence.
5. I on my part for last more than a year (we were forced to take possession by Landlord and Mahda based on Partial occupation certificate issued to new building in March 2005) have been raising these issues with Landlord and Mandal and even issued them several letters sighting the terms of agreement not fulfilled. However till to day none of letter has been replied.
6. Landlord is delaying by purpose society registration because he gets money to issue NOC for people who are buying the flats from the old tenant. He perhaps also expects some FSI or other benefit and therefore delaying the society formation which he was required to do within 4 months of “virtual” completion of the building. 21 months have passed since we shifted under pressure of Mhada based on partial occupancy certificate.
I seek your guidance in the subject to decide what should I do now. Which government agency is responsible to ensure that Landlord/Builder/Developer fulfills his contractual obligations and the old tenants do not suffer.
