Hand over land for dumping ground: HC
Mumbai: The Bombay high court has directed the Centre and the state government to hand over possession of 141.77 hectares of land in Kanjurmarg for a new dumping ground on October 24.
A division bench of chief justice Dalveer Bhandari and justice Dhananjay Chandrachud asked a representative of the Union government and the secretary of the state government to visit the site on October 24 and hand over the documents granting the corporation possession of the salt pan land. The issue came up before the judges after Gorairesident Vijay Daruwale filed an application saying that the authorities had failed to implement the court’s orders. On July 20, the high court had ordered the shifting of the dumping ground from Gorai to Kanjurmarg as per the judgment of the Supreme Court. On Tuesday, the state and the Union of India passed the buck over the delay in giving the corporation the land. Assistant advocate general Ashutosh Kumbhakoni informed the court that the Union government owned the land and despite an application there was no response. Additional solicitor general B A Desai in turn blamed the state government. “No efforts have been taken by the state government to take possession of the land. The court orders were passed in July and the state approached the Centre only on October 5,’’ said Desai. “The sent a letter to the salt commissioner based in Jaipur, whereas they should have approached the commerce ministry which owns the land,’’ he added. |
