In the absence of ‘National Judicial Commission’ it is a difficult task. People have lots of grievance against judges, courts function and other judicial matters. There is no forum or to address public grievance and redressal mechanism available in India. The voting masses in India have no power to present their grievance or the problem facing from judges/ courts etc.
Peoples right and Freedom of expression under threat due to wide power given to judges and unwanted use of contempt of court. People cannot question judges wrongful action which lead to contempt of court especially High Court and Supreme Court judges. There is no transparency, accountability and responsibility of judiciary and judicial officers. Many cases might have settled in one or two sitting. But that is not happening in India. Another problem is cumbersome procedure and law with sections, sub-sections, etc.
Judges and advocates are not ready and willing to accept the reform in justice system and they are comfort with the present system. All these added complaint against judiciary and judicial functions and public lost hope in judiciary. Complaint against judges and judiciary is increasing day by day. But every elected govt. have no intention to setting up National Judicial Commission and Public Complaint Cell. This authority should look into the cases against judiciary and judicial officers and staff of all courts in India. Both State and National Judicial Commissioner need to set up.
In Independent India, Indian judiciary is autonomous and has wide power. Even though, it failed at all front in disposing the cases timely. Judiciary is not accountable to people. Judiciary or judges cannot ask any more power and autonomy. It is time to create an independent State and National Judicial Commissions. Without impeachment in Parliament, no sitting judges of High Court or Supreme Court can be removed. Parliament and law commission need a relook on this issue.
Can we expect a National Judicial Commission in the near future or from the next government at the centre? What is the opinion of the political parties on this issue. Let us have a debate on this issue.
