Two builders, Krishnamilan Shukla and Sandeep Shukla from Buildtech Engineers, have moved the sessions court for anticipatory bail after senior Crime Branch officers allegedly threatened to slap a case on them if they did not return the money to rival builders.
The police, who have booked the two for cheating and criminal intimidation, claim that the two builders have links with underworld don Dawood Ibrahim’s sister Hasina Parkar.
The duo in their anticipatory bail application (ABA) stated that in September 2006 they met Chandresh Shah (now arrested by ACB), Vinod Avlani and one Shamim, representing Ravi group of companies, for development of a slum rehabilitation project through a joint venture.
The venture, according to the ABA, provided Ravi group to pay Rs 1 crore. In October 2006, Shah and others handed over a DD of Rs 30 lakh to Buildtech Engineers with the remaining sum to be paid at the time of execution of the JV. According to the Shuklas, Shah started “provoking and misguiding the members of society and promotees”. On January 2007, say Shuklas, Avlani asked them to sign and execute an agreement of JV by accepting Rs 20 lakh instead of Rs 70 lakh, to which they refused.
The application further states that in February and March, Senior Police Inspector of Crime Branch (unit 1) Anil Mahabole and Police Inspector Rajendra Nikam would call them from Shah’s mobile phone and threatened them to execute the agreement or pay back Rs 30 lakh plus interest to one Raju. Mahabole and Nikam also asked the Shuklas to pay up Rs 10 lakh to them by way of settlement, the application said.
As per the ABA, on March 1, Nikam recorded Sandeep Shukla’s statement. On March 28, Krishnamilan Shukla approached the ACB and lodged complaint against Mahabole, Nikam, Shah and others.
The Crime Branch has filed an FIR on Krishnamilan Shukla, Sandeep Shukla, Chandresh Shah, one Maqsood and Arshad after a complaint made by Vinod Avlani.
According to Avlani, one Jayendra Shah took him to the Shuklas who promised him a JV of two profitable projects. Shah arranged a meeting in Parkar’s flat. According to Avlani, Chandresh and Shuklas signed an agreement in which Avlani was to provide Rs 1 crore. Chandresh and the Shuklas, according to him, took Rs 30 lakh from him, but didn’t return. Therefore, he filed a case of cheating and criminal intimidation.
The Crime Branch said that they want to verify Avlani’s claims about the Shuklas having underworld link and about the SRA project being handled by Parkar.
