B. Complaint Details
1. The CWC has been our tenant since 1977.
2. In the year 2000, the Regional Manager of CWC in Mumbai sub-leased our premises to a third party (Han Motors) after signing an Agreement with the third party, despite this being contrary to the CWC rules and bye-laws, and despite this being contrary to the Agreement between us and CWC.
3. In the year 2001, we filed a suit against CWC and the third party for eviction, and the Court ruled in our favour in 2007, directing CWC and the third party to vacate our premises.
4. In 2009, CWC surrendered all the premises except those occupied by the third party.
5. Since July 2009, CWC has not collected monthly rent from the third party, while continuing to let them occupy the premises. The total rent to be paid to CWC is approximately Rs. 50 lakhs.
6. CWC has not taken any action to evict the third party from the premises, nor recovered dues for occupying the same premises.
7. We have requested that CWC institute a departmental inquiry regarding the loss of revenue of over Rs. 50 lakhs to CWC, and hence to the Citizens of India, due to the the occupation of CWC leased premises by a third party after expiry of their mutal agreement, and the non-payment of rent payable to CWC.
8. No action or departmental inquiry has been undertaken so far.
9. This implies an endorsement by CWC of such an unlawful act of it’s own employees, and also indicates an intent by CWC to cheat the public.
10. It appears that such illegal possession and occupation of the said go-down has happened with the knowledge, permission or connivance of the CWC official, who is technically still in possession of the godown, and is still locking the same every day, and is still to hand over the possession of the same to us.
C. Suggestions
1. CWC recover dues of Rs. 50 lakhs from the occupier of the CWC leased premises, as this amount is due to the Public Exchequer.
2. CWC evict the occupier of the CWC leased premises and hand-over possession to us.
3. CWC to institute an enquiry as to why illegal acts have been committed by the CWC Regional Manager, resulting in loss of revenue to CWC, thus indicating that the personal interest rather than the public interest has been served in this case.
