B: My Complaint Details | |
1. Period of incident: | Before 2007 – May |
2. Services that were sought: | One complaint was submitted against Sri Surath Kumar Biswas, Jt. Registrar . Without getting any proper result from Co op. Deptt ,it was submitted to the Chief Minister, One concocted report was prepared by one enquiry officer of the same Dept. to exonerate him from all charges, Secretary accepted |
3. Problem/s I faced: | Enquiry officer concluded as ” Sri Biswas was innocent and allegations levelled against him are baseless and malacious.En. officer did not provide any oppourtunity to complainants to place their views during enquiry. He only supported the corrupt officerm without going to the evidence of proof. |

Details of Content: | Sri Surath Biswas served the purpose of Corrupt Board members of Metropolitan Coop. Soc and violated all directives of the High Court and helped elected them withhelp of illegally prepared voters’list |
D: My Suggestions | |
1. For head of government department: | |
Suggestion 1: | A responsible Govt. officer did illegal activity and he violated all the directives of the High Court but as he submitted one compliance report to the High Court , the Govt . Department would not take any action against that corrupt officer on that plea ? Is it approved by the conduct rules of the Govt. Dept ? . Even when with the documentary evidence it was proved that Mr had submitted false statement, why no action was taken ? The High court did never approve the illegal activities of that corrupt officer. Now the petitioners may once again go to the Court, but my question is why proper administrative action will not be taken for this gross illegalities committed by that corrupt officer . Why corrupt officer will not be punished? The Department could not deny the evidence of his false statement any where. One enquiry was conducted by the concerned Govt Department , but the enquiry officer could not produce any documents in favour of the corrupt officer. The enquiry was |
Suggestion 2: | The High Court did not accept his compliance report and did never approve the election held in 2004. So the collusion between the ex. MC members and Dr. S.K.Biswas, the then Administrator was proved beyond doubt. From the remark of the then Secretary of Co op.. Department on the findings of the enquiry report , it seems that he did not go through the enquiry report as well as the High Court’s Orders properly, otherwise he should not have supported all those findings of the said report. |
Suggestion 3: | Sir, I would request you to kindly go through my clarification provided herewith to justify my request for the fresh enquiry vis-a vis the documents lying with Co operation Department and Co operation Directorate which will substantiate my claim for a fresh enquiry against Sri Surath Biswas, who escaped punishment for all his misdeeds. All the documentary evidence have already been submitted to the Registrar and to your office. But I am ready to submit all those documents , if needed, once again only to prove that allegations against that officer by so many members of the Metropolitan Co operative Society were correct and based on proper reasoning. Now I would like to clarify different allegations against Dr S.K.Biswas , (as mentioned by the Enquiry officer) with the help of concerned High Court directives as well as authenticated information received from the Co op. Directorate . |
2. For the Anti Corruption Bureau (ACB) / Central Bureau of Investigation (CBI): | |
Suggestion 1: | 1. Election on fraudulent voters’ list. The enquiry officer , supported Dr. Biswas’s role in this regard by stating that ” I do not find any substance in the allegation that Shri Biswas organized the election on a fraudulent voter list”. The Hon’ble Division Bench of Calcutta High Court directed to ” hold election after elimination of disqualified members —” (FMAT/299/1985 dated 22.07.1994). Did Shri S. Biswas followed this specific direction of the Division Bench? He did not ‘eliminate’ a single member of the Metropolitan Co operative Housing Society. He did not allow 60 panel members to become the members of the Society , rather cancelled the empanelment (though he was not empowered to do that at all as per Court’s order) In this regard Shri Biswas himself admitted that —- The records do not reveal that R.C.S. W.B. finally resolved the membership dispute of the Metropolitan Co op. Housing Society Ltd. In View of the above , question of elimination doesn’t arise |
Suggestion 2: | What was the specific direction of the Hon’ble Division Bench regarding membership dispute of the Metropolitan Co op. Housing Society ? ” there is a strong dispute regarding the membership. This dispute has not been resolved nor could it be resolved by the Special Officer appointed by this Court. This could be resolved only by the Registrar, Co-operative Societies. Such being the position, an election held without a resolution of such dispute regarding the membership should not be allowed . |
Suggestion 3: | What was the specific direction of the Hon’ble Division Bench regarding membership dispute of the Metropolitan Co op. Housing Society ? ” there is a strong dispute regarding the membership. This dispute has not been resolved nor could it be resolved by the Special Officer appointed by this Court. Suggestion 1: | b)) The Enquiry Officer did not pass any document in his enquiry report whether Sri Biswas correctly followed the judgment of Hon’ble High Court. But as per the Govt Rule there should be all relevant supporting documents along with the enquiry report. But in this case ‘he did not submit any paper in support of his observation’ 2. Shri S.K.Biswas did not take any action against members of past Managing Committee In his enquiry report Shri Guha Majumder opined that .. ” the allegation against Shri Biswas that he did not take any action for the misappropriation of fund by the past managing committee does not hold much water also. ” . And he also mentioned — ” he appointed a Chartered Farm to scrutinize such allegation.. |
Suggestion 2: | . But Shri Biswas was dedicated to serve the purpose of the past Managing Committee members only. So he did not ask anything regarding ‘defaults committed ‘ by them either to the ex Administrator Shri A.K.Mukherjee, who submitted report to the Division Bench of the Calcutta High Court as per High Court’s directive , or to the Registrar .As such the then Registrar sent show cause notice to all members of the past Managing Committee on 12.031997 |
Suggestion 3: | As such the then Registrar sent show cause notice to all members of the past Managing Committee on 12.03.97— ” in obedience to the orders of the Hon’ble Court as aforesaid together with the relevant Audit Reports in exercise of my powers U/ Sec 129(1) of the W.B.C.S. Act,.” Further the then Registrar of Co op Societies, W.Bengal directed the Administrator of the said Society “to lodge F.I.R. to the local Police Station against the erstwhile members of Board of Directors of your society |
