D: My Suggestions | |
1. For head of government department: | |
Suggestion 1: | I have been attending Small Causes Court since more than 16 years. My experience shows that most of the litigations are dragged and delayed not due to the paucity of staff and judges but due to the delaying tactics adopted by the losing side. If the losing party is also wealthy and powerful then the judges too are won over and bow to their demands. Applications are made to secure Adjournments and Judges give Orders to take Dates by Consent . The Judicial Clerks in Small Causes Court are easily bribed to give long d ates by the losing side. Honest litigants are made to travel to and fro on every date only to take dates. Even when the litigation is at the stage of recording evidence i.e. cross-examination after recent amendments, all rules of Civil Procedure Code are ignored. Judgments are delayed even when evidence on Issues framed by the Court is complete and on record. There is no supervision, authority and restraint over the delaying tactics adopted by the losing parties. |
2. For the Anti Corruption Bureau (ACB) / Central Bureau of Investigation (CBI): | |
Suggestion 1: | Hold inquiry into the litigations pending in Courts even when Evidence on all Issues is on record. Catch the corrupt officials who give frequent adjournments and hold them responsible corruption and for dragging and delaying the litigation. |
