I have dealt with, eg. Magistrate Courts, Small Causes Court &
Sessions Court, Mumbai In every court, the staff will carry out
orders of the court to issue summons, warrant, give certified
copies, etc. only on getting their hands greased. Advocates are
encouraging it. Peons run after advocates and their clients to
collect money. Hence, this complain may be sent to Judicial
Authorities for systamic improvement rather than particular
individual though I have number of specific

1. Period of incident 2007 – Dec
2. Services that were sought? Get certified copies,
warrants, summons, etc.
3. What problem/s did you face? The clerks concerned do not
give the papers or prepare them without agreeing to pay.
4. Bribe amount Rs. 50 onwards for each matter
5 a. Did you pay the bribe? If yes, why? On a couple of
occasions, as instructed by Advocate. Normally, my assistant has to
pay to get their official work done.
5 b. Could you get your work done without paying the bribe?
if so, how? No
6. Result Even when payment is required to be made, they
cause abnormal delay so as to extract money and to make the work
appear difficult. So we suffer on both ground

D: Suggestions
1. Suggestions for head of government department Pl. bring
such rampant corruption to the notice of Judicial Officers,
particularly the Chief Justice so that some corrective measures
would be initiated which would reduce corruption to some extent.
2. Suggestions for the Anti Corruption Bureau (ACB) / Central
Bureau of Investigation (CBI) Notify the Chief Justice who in turn
would instruct lower functionaries and the staff would be on guard.
3. Suggestions for other citizens Resistance to pay results
in your critical work held up. Hence, the clients are totally at the
mercy of the clerical staff of all courts. I have come across just
one or two clerks who do not take bribe. People pay up because of
the crucial nature and importance of time factor and the amout
involved is small. Similarly, the Bar Councils to be instructed by
ACB?Vigillance Commision to instruct their members to desist from
paying/making clients pay bribe. There are serious instances of
Judicial Officers also which I do not wish to cover now.
