Chief functionary/ Secretary to the NGO
Sub: Participation with the activities of Lokayukta-Govt and civil society network for good governance.
Lokayukta is a one-man institution created by the West Bengal Lokayukta Act, 2003, for investigation into the complaints by the citizens against the public functionaries in west Bengal alleging corrupt practice by them and non-exercise of their power and for matters directly connected there with .corrupt practice means that the concerned public functionary in any of his action has been guilty of willful lack of financial integrity and/or willful abuse of power for personal gain.
We are requesting you to participate in the activities of Lokayukta to spread out its network and to implement the Community based Action Plan. Here we are giving you an idea about the role ,objective and activities of Lokayukta.
In India, the first Administrative Reforms commission headed by Late Shri Morarji Desai recommended creation of such Institution in different state and also at the centre to be termed LOKAYUKTA and LOKPAL respectively. Since then as a part of administrative reforms, different state of India created the Institution of Lokayukta by state enactment such Institution
West Bengal is the 21st state to have created such an Institution by the West Bengal Lokayukta Act, 2003 which came into effect on and from 1st of February, 2006.
Objectives of Lokayukta:
· Ensure transparency and more accountability in the administration;
· To rectify the malpractices in the administration;
· To address the issue of peoples grievances;
· To facilitate the process of good governance so that people can access the effect of good governance;
· To cover the complainants with back up support (in order to protect the complainant from any kind of threat and harassment). Here NGO can extend cooperation for protection of the complainant.
· To provide speedy, cheaper form of justice to people;
· To reduce and gradually to dent in mounting corruption in public administration;
· To check and control over abuse and misuse of power by public functionary and also willful non-exercise of powers;
Actions need to be taken:
a. State Level Network (A committee has to set up headed by the Honble Lokayukta comprise of representatives from both government & the NGOs)
b. District Level Network (A committee has to se up headed by the DM comprise of representatives from both government & the NGOs)
c. There will be Complaint Box at the Gram Panchayat, Block, SDO and DM offices. People will drop their complaints in the box. Two personnel have to make responsible to open the box weekly. They have no right to open the complaints. After opening the box they must send those to the Lokayukta as quick as possible.
d. To involve the personnel of three tier Panchayat
e. Sensitization & Awareness about the structure & functions of Lokayukta
f. Procedure of lodging complains
g. Capacity Building of the NGO & CBO activists
h. Facilitate the complainants so that people can access the facilities /opportunities available with Lokayukta-Institution
i. Arrangements of Interactions about the functions of Lokayukta
j. Government/KMC/councilors-Sensitization
k. Advocacy & lobbying with the legislators- To have discussions with the CM, Speaker, WB, Leader of Opposition in the Assembly
l. Advocacy for including the bureaucrats under the purview and jurisdiction of Lokayukta
m. Tenure of Lokayukta is to extend up to 5 years instead of 3 years
n. To involve the Media for amplifying the functions of Lokayukta
o. Recognize the committee which is set to function under the Lokayukta
p. Invite 10-15 NGOs in the office of the Lokayukta and Honble Lokayukta will have discussions with them about the functions of this institution.
q. Preparing a list of NGOs with their postal address, telephone number, e-mail etc.
Role of Lokayukta, Government and Civil Society Network for Good Governance:
The forum has to play pivotal role in facilitating the function of Lokayukta Institution by undertaking sensitization and awareness generation program at the state level to grassroots level. Since the Lokayukta Institution is a new initiative therefore, it is the reality that people are not aware about their rights. The issues need to be addressed in the sensitization & awareness programs would be:
v What is the purpose of West Bengal Lokayukta Act, 2003
v Who are the public functionaries against whom such investigation can be made by the Lokayukta
v Who can complain and against what one can complain and where one can complain;
v Who is the competent authority
v In what manner the complain has to be made and what are the procedures for filing a complain
v How the institution of Lokayukta functions after receipt of the complaint
v How people ventilate their grievances
v How the Lokayukta ensure transparency, good governance and make public functionaries free from abusing power and willful non-exercise of power
West Bengal Lokayukta headed by Honble Justice Samaresh Banerjee is going to implement a Community based Action Plan . The prime objectives of this Plan are,
(i)Access to justice for all, (ii)Transparency in administration and (iii)Ensuring good governance to the grass root level. To implement this plan successfully we need your cooperation and participation.
You can apply for membership for district level network, and you can also identify a block / ward etc. to work with .
First copy of your application must be submitted to Distinct magistrate / CEO of the municipality / Commissioner of the corporation and the xerox of received 1st copy have to attached with the 2nd copy and have to submit to the Secretary to the Net work Lokayukta West Bengal .
