RS clears bill allowing single women to adopt
The Rajya Sabha on Tuesday took a major step towards empowering women in regard with their rights to guardianship and adoption of children, irrespective of their marital status. The Personal Laws (Amendment) Bill, 2010, was cleared from the Rajya Sabha on Tuesday. It will now be placed before Lok Sabha.
According to the law, if a couple wants to adopt, the father is the natural guardian. The
proposed amendment to the Guardians and Wards Act, 1890, includes the mother to be appointed as guardian.
âOn the basis of recommendations made by the Law Commission of India, the bill provides for the mother to be appointed as a guardian along with the father so that the courts donât appoint anyone else, in case the father ceases to exist,â Law Minister M. Veerappa Moily said.
The second amendment proposed in the Hindu Adoption Maintenance Act, 1956, aims to remove hurdles in the way of a married woman to adopt and also give a child in adoption.
